Greetings, The Friday Whine is a casual email to friends and colleagues and contains three things: An ethics update, a legal profession update, and wine recommendation. If you see text in blue, it is a link to an article or information.
Ethics
“SERVICE OF COURT DOCUMENT” is a real thing
Now that we all e-file, we know that when we serve a pleading, we put in the e-mail subject line “SERVICE OF COURT DOCUMENT, and the case number.
If you practice civil litigation, you know what “57.105” means. It means sanctions. You write a “safe-harbor” letter to the opposing lawyer, and then after 21 days you can file the motion.
Turns out that service of the safe harbor letter has to be done with that whole SERVICE OF COURT DOCUMENT thing in the email, 0r the sanctions will be denied.
At least according to the Fourth DCA.
Imagine a legal malpractice case because you failed to get sanctions because you didn’t serve the safe harbor letter pursuant to the Rule?
Legal Profession
The Nomadic Lawyer’s Update
In my book The Practice I write a lot about Lee Rosen.
Lee built a great family law practice in North Carolina and then got rid of everything he and his wife owned except what would fit in two carry on suitcases. He now has no home. Airbnb, Uber, and other modern ways of living are how he gets around.
He just passed two years of living this way. Here’s a podcast about his experience, and here’s an article he wrote after one year.
Wine
Cremant
Cremant is Champagne that’s not made in Champagne. So as I’ve said before, Champagne is only from Champagne. Cremant is “kind of like” Champagne, it’s just not, Champagne.
The other night I reluctantly showed up to a wine dinner at the “come at 6:30 for bubbles” time. I generally hate “bubbles,” but decided to go early anyway.
I was glad I did, because this $17 Cremant was great. I actually asked for a second glass.
