https://on.tdo.com/2K6WE9K Etters, Karl. Defense attorneys representing the men still facing trial in connection with to the death of Andrew Coffey continued to assert that without specifically stating what their clients are charged with they can’t go forward.
During a lengthy hearing, attorneys for Luke Kluttz, Anthony Oppenheimer and Anthony Petagine – who all face charges of hazing in connection with the Nov. 3 death of the Pi Kappa Phi pledge – argued the case against their clients should be dismissed.
The three men, and Clayton Muehlstein, are the remaining defendants of nine people charged with pressuring Coffey into downing a bottle of bourbon during the fraternity’s annual Big Brother night.
The party where older members provide alcohol to pledges is part of a semester-long pattern of coercion, State Attorney Jack Campbell contends.
However, Josh Brian, an attorney for Oppenheimer, asserted that simply being part of the fraternity and its activities does not constitute participation in hazing.
“They just want to say that if you were part of the organized fraternity process then you are stating you aided and assisted in a criminal act,” he argued before Leon Circuit Judge Martin Fitzpatrick. “Everything is generalized in this case. That’s the problem.”
