MIAMI, FL– December 30, 2021- Bast Amron attorneys Brett M. Amron and Lissette M. Carreras obtained a resounding legal victory in their representation of a California company in a lawsuit for breach of a promissory note in the U.S. District Court for the Southern District of Florida.
The client did not do business in Florida, and all terms of the promissory note required performance in California. The payment provisions, however, were notably silent regarding the place of payment which took place in Florida. Bast Amron filed a Motion to Dismiss for Lack of Personal Jurisdiction, Improper Venue, and in the alternative to Transfer Venue.
The Motion was highly contested, and the Plaintiffs filed a Motion for Summary Judgment along with their response to the Motion to Dismiss. Ultimately, the Court granted the Motion to Dismiss and adopted our client’s position stating, “I agree with Defendant that the contacts Plaintiffs have identified are insufficient to subject it to personal jurisdiction in Florida under binding precedent.”
